Article 1 These regulations are formulated in accordance with the “Decision of the CPC Central Committee on Deepening the Reform of Party and State Institutions” and the “Provincial Institutional Reform Plan” approved by the Party Central Committee and the State Council. Article 2 The Department of Commerce is the provincial government departments, for the departmental level. Article 3 The Department of Commerce implement the policies and decision-making arrangements of the Party Central Committee and the Provincial Party Committee on commercial work, and adhere to and strengthen the Party's centralized and unified leadership of commercial work in the process of duties. The main responsibilities are: (1) Responsible for domestic and foreign trade, foreign investment, investment abroad, and foreign economic cooperation. To draft local laws and regulations related to local regulations for business and formulate provincial business development strategies, plans and policies and organize their implementation. Organize the implementation of the opening-up strategy, explore domestic and foreign markets, and promote the integration of domestic and foreign trade. Formulate business big data development plans. (2) Coordinate domestic trade circulation work. (3) Responsible for promoting consumption in the commercial sector and cultivating consumer promotion platform. Formulate development plans for the province's gas stations and refined oil storage industry, and be responsible for the supervision and management of refined oil business activities. Responsible for cultivating time-honored and other commercial brands. Responsible for the supervision and management of single-purpose commercial prepaid cards. (4) Take the lead in coordinating the rectification and standardization of market economic order, formulating policies of regulating market operation and circulation order, and organizing implementation. Monitor and analyze market operations, commodity supply and demand conditions, and commodity prices, and carry out forecasting, early warning, and information guidance. Responsible for credit construction in the business field. Promote the construction of traceability systems for important products. (5) Responsible for e-commerce comprehensive coordination and industry management. Formulate relevant policies to guide and support the development of e-commerce platforms, e-commerce service systems, e-commerce industry bases, etc. together with relevant departments. Promote the development of cross-border e-commerce and the construction of comprehensive pilot zones. Carry out statistics, operational monitoring, and service support system construction in the e-commerce industry. (6) Responsible for the overall coordination of exhibition industry development. Organize the formulation of exhibition industry development policies. Coordinate the standardization and innovative development of the exhibition industry. Guide the construction of exhibition platforms and exhibition activities at home and abroad. (7) Responsible for building a foreign trade promotion system. Promote new trade methods and speed up the construction of cross-border supply chains. Promote the transformation of the development mode, structural optimization and upgrading of foreign trade. Responsible for the management of foreign trade operators. assisting enterprises in exploring international markets. (8) Responsible for import and export management and promotion. Organize and implement the total import and export plan of important industrial products, raw materials and important agricultural products. Coordinate with relevant departments to manage bulk import and export commodities. Manage import and export quotas. Responsible for the import and export management of mechanical and electrical products, high-tech products and large-scale complete equipment. Undertake import and export management of dual-use items and technology in accordance with authority. (9) Responsible for international trade in services and trade in technology. Guide the opening up of the service trade field to the outside world, promote the development of international service trade, and promote the construction of service trade exchange and cooperation platforms. Responsible for the management of technology import and export throughout the province. Responsible for managing and promoting the international freight forwarding logistics industry. Cooperate with relevant departments to guide and manage production safety in the commercial service industry (including catering, accommodation, e-commerce). (10) Responsible for import and export fair trade work and trade remedy investigations. Organize and coordinate anti-dumping, countervailing, safeguard measures and other work related to fair trade in import and export. Establish and improve warning mechanisms for foreign trade and industrial damage. Responsible for trade policy compliance throughout the province. Guide the province's response to various trade friction cases and industrial security. Lead the coordination of affairs related to the World Trade Organization. (11) Responsible for the promotion and management of domestic and foreign investment throughout the province. Responsible for the overall planning of attracting domestic and foreign investment throughout the province, and organize collaborative investment promotion at the provincial level. Guide the whole province to establish and improve the investment network. Responsible for investment promotion goal formulation, conducting statistical monitoring, evaluation and assessment. Carry out management and services for foreign-invested enterprises in accordance with the law, and supervise and inspect the implementation of laws, regulations and rules on foreign investment. Guide the safety management of overseas investment cooperation projects. (12) Responsible for the management of national economic and technological development zones and provincial economic development zones. Carry out comprehensive coordination, guidance and management of national economic and technological development zones, special customs supervision zones, provincial economic development zones, and other open platforms within the management sequence of provincial economic development zones. Responsible for the assessment and operation monitoring of development zones. (13) Responsible for the implementation of the National Pilot Free Trade Zone strategy. Implement multilateral and bilateral free trade agreements, and study and formulate policy recommendations for the construction of provincial free trade pilot zones. Study important matters relating to the reform and development of the Pilot Free Trade Zone, and undertake the task of coordinating the pilot reform of the Pilot Free Trade Zone. Guide and implement the replication and promotion of the innovative experiences and achievements of the Pilot Free Trade Zone throughout the province. (14) Responsible for external investment and economic cooperation. Responsible for the supervision and management of overseas investment, foreign labor cooperation, etc. Responsible for the supervision and management of overseas contracted projects and their safety production. Responsible for overseas investment management of enterprises in the province (excluding financial enterprises). Responsible for the construction of overseas hub projects and overseas economic and trade cooperation zones. Promote international production capacity cooperation in accordance with the division of responsibilities. Undertake the protection of the rights and interests of expatriate workers. Handle overseas economic and trade disputes and emergencies. Responsible for multilateral and bilateral aid and foreign aid work. (15) Responsible for foreign economic and trade exchanges. Lead the promotion of multilateral and bilateral economic and trade exchanges with other countries and regions. In accordance with the authorization, the organization undertakes matters such as personnel going abroad (outside) on business and inviting people from outside the country (outside) to visit. Lead the organization of major economic and trade exchange activities both domestically and internationally. Promote the construction and management of our province's foreign economic and commercial institutions in an integrated manner, and expand the overseas economic and trade cooperation network. (16) Complete other tasks assigned by the Provincial Party Committee and the Provincial Government. (17) Functional transformation. Guided by the “run at most once” reform, we will deepen the reform of the circulation system, improve the institutional mechanism for promoting consumption, develop modern distribution methods, accelerate supply chain innovation and application, the construction of new trade centers, and the construction of high-end consumer gathering platforms, promote the development of digitalization, platformization and branding in the distribution sector, and build a strong circulation province. Guided by the construction of the "the Belt and Road", we will develop new business modes such as cross-border e-commerce, market procurement and integrated foreign trade service platforms, improve the competitiveness of export products, build high-quality product production and sales sites, optimize the foreign investment structure, strengthen foreign investment services, build high-quality foreign investment centers, guide orderly foreign investment, build high-level foreign investment strategies, continuously deepen opening-up to the outside world, enhance the benefits of opening up to the outside world, and create a strong open province of opening up. (18) The division of responsibilities relating to investment promotion. Responsible for coordinating the attracting of domestic and foreign investment, guiding the establishment of a province-wide investment network, working with relevant departments to carry out attraction planning and investment promotion for major industrial projects, ensure projects are well-resourced and follow-up services are duly rendered. The Provincial Development and Reform Commission is responsible for monitoring and tracking the entire process of provincial, municipal and county governor projects, working with relevant departments at the provincial level to carry out ongoing and ex post oversight and follow-up services for domestic and foreign projects, ensure coordinated and balanced provision of resources concerned,be responsible for investment management, plan the development direction of key industries, and undertake engagement with central enterprises. The Provincial Department of Economy and Information Technology is responsible for guiding the province to improve the map of key industrial chains, proposing the demand for attracting cooperation in industry and information technology fields, and collaborating to promote precise investment in the local industrial chain. The office of the provincial government in Beijing and the office of the provincial government in Shanghai respectively collaborate to undertake liaison services for attracting investment in the Beijing-Tianjin-Hebei and Yangtze River Delta regions. | ||
